OJAI VALLEY NEWS POLICY: In felony arrests of this nature, the OVN will not publish the names of the suspects until after they have been arraigned.
Suspects: Two Oak View men, ages 18 and 20
The Ventura County Sheriff’s Department’s Ojai detectives and patrol deputies concluded an investigation into a child abuse case in which one suspect kicked a four-year-old male child in the groin while another suspect videotaped it. The investigation started when a patrol deputy was given a found cellular phone. When the deputy attempted to identify the owner of the phone, he located a video in the phone showing a four-year-old male child being kicked in the groin by an adult male. The child abuse case occurred in December of 2009, but was not reported until the deputy uncovered the video.
During the investigation, the two suspects were identified and ultimately arrested for 273a(a) – Child Abuse. At this time, the suspects are in custody in lieu of $50,000 bail.

Death Penalty and Innocence

Arizona: Ray Krone, released in 2002
Spent 10 years in prison in Arizona, including time on death row, for a murder he did not commit. He was the 100th person to be released from death row since 1973. DNA testing proved his innocence.
Illinois: Madison Hobley, Aaron Patterson, Stanley Howard and LeRoy Orange, pardoned in 2003
Sent to death row on the basis of “confessions” extracted through the use of torture by former Chicago Police Commander Jon Burge and other Area 2 police officers in Chicago. They were pardoned by outgoing Governor George Ryan, who also commuted the remaining 167 death sentences in Illinois to life imprisonment.
North Carolina: Jonathon Hoffman, exonerated in 2007
Convicted and sentenced to death for the 1995 murder of a jewelry store owner. During Hoffman’s first trial, the state’s key witness, Johnell Porter, made undisclosed deals with the prosecutors for testifying against his cousin. Porter has since recanted his testimony, stating that he lied in order to get back at his cousin for stealing money from him.
Yeah!!!I trust the system! This is just a pinch compared to the exact number and the innocent that were executed before they were proved to be innocent.
I understand you don’t care because you didn’t know these people, but consider you may have known them or even further, consider if it were YOU!
I’m not suggesting they did not do the act, I am insisting they explore all possibilities beyond a shadow of a doubt that they explore all the evidence before their conviction in case they were just acting.
Being convicted of felony child abuse should be a greater punishment compared to just playing a jack ass hoax I would think.

I hope that the truth will come out, and whom ever is at fault will face the consequences imposed by the judicial system. The Fifth Amendment of the U.S. Constitution reads, in part, “No person shall be … deprived of life, liberty, or property without due process of law …”
What this means, in plain terms, is that constitutionally you cannot be executed, imprisoned, or fined without the proper course of justice taking place. Due process, itself, is not defined in the constitution, but is universally recognized as meaning what we term as “a fair trial.”
Presumption of innocence is a legal right that ‘we’ all are granted. It states that no person shall be considered guilty until finally convicted by a court. The burden of proof is thus on the prosecution, which has to convince the jury that the accused is guilty beyond a reasonable doubt. In principle, the defense does not have to ‘prove’ anything. However, the defense may present evidence tending to show that there is a doubt as to the guilt of the accused.
